visa refused- need to go overseas

Hi there,

I need a help. My 485 visa was refused yesterday but I need to go overseas urgently. I have no visa at the moment. If I go overseas can I come back and appeal that refusal?

Hello Charlie,
I assume you held a substantive visa (eg a student visa) when you applied for 485 visa. I also assume you haven't applied for a bridging visa B.

Therefore, you currently hold a bridging visa A and will continue to hold it 28 days after you have been notified about a decision to refuse your 485 visa. If you were notified about that decision by an email, you are taken to have been notified about that decision at the end of  the day you received the email. If they sent you a letter by mail, add another 7 working days since the letter was dated.

As a bridging A visa holder, you do not have authority to return to Australia because your visa ceases when you leave Australia. You need to obtain a bridging visa B which will cost you $140. However, to be able to get it, you need to apply for a review of the decision to refuse your 485 visa application ($1,604). The problem I see here is, even if you do all of those steps, the average processing time of bridging B visa is 1-2 weeks usually.
