Hateful conduct - character visa refusal and cancellation

- to introduce a broad package of reforms across several Commonwealth laws aimed at strengthening Australia’s response to antisemitism, hate‑motivated conduct and extremist activity. The Bill proposes to make changes within the Migration Act 1958 and the Migration Regulations 1994 by expanding key definitions, broadening the character test, updating the meaning of “character concern,” and clarify ministerial powers to refuse or cancel visas where there is a risk a person might engage in hate‑related or extremist activity. The Bill also extends permanent exclusion provisions in the Migration Regulations and makes consequential amendments to the Australian Citizenship Act 2007.

Temporary Visa Subclasses for PIC 4005 and 4007

The purpose of LIN 26/021 is to specify temporary visa subclasses for subparagraphs 4005(2)(b)(ii) and 4007(1A)(b)(ii) of Schedule 4 to the Migration Regulations. LIN 26/021 repeals and replaces LIN 22/007 in order to revise and update references to various visa subclasses.

The Amendment Instrument amends Standard 4 of the National Code, relating to education agents, to provide that a registered provider must not give an education agent commission to an education agent, where the commission is in relation to the recruitment of an overseas student who has commenced studying in a course with another registered provider. There are three exceptions to this:

  • where a student is recruited for a course and becomes an accepted student (as defined in the Act) of the provider on or before 31 March 2026; or
  • where a student is recruited for the course delivered by the provider, as specified in the confirmation of enrolments (CoE) (as defined in the National Code), for which the student’s student visa was granted;
  • where a student is recruited for a course that commences after the student has completed their principal course of study with the other registered provider.

Registered Migration Agents Legislation

The Regulations will have improved clarity and readability, and make some minor changes to improve efficiency and effectiveness of the 1998 Regulations, in line with the views received following extensive consultations with key stakeholders. The Regulations include provisions (amongst others) which:

  • outline employer and employee definitions;
  • refine the definition of assistance given by close family members;
  • define information requirements for the Register of Migration Agents;
  • prescribe the continuing professional development requirements a registered migration agent (RMA) must complete to enable reregistration application; and
  • prescribe the minimum requirements for Professional Indemnity Insurance.

Migration Legislation (Migration Agents) (Repeal and Consequential Amendments) Regulations 2026 https://www.legislation.gov.au/F2026L00120/asmade/text

The purpose of the Amendment Regulations is to repeal the 1998 Regulations and to make consequential amendments to the Migration (Migration Agents Code of Conduct Regulations 2021 (the Code of Conduct) and Migration Regulations 1994 (the Migration Regulations) to give effect to the relevant sections of the Regulations.

The Migration Agents Registration Application Charge Regulations 2026 (the Regulations) repeal the previous Migration Agents Registration Application Charge Regulations 1998 (the 1998 Regulations) on 1 April 2026. The Regulations streamline, clarify and modernise the 1998 Regulations, ensuring that they are fit for purpose.

485 Graduate visa - VAC increase

Temporary Visas Eligible for AMEP

The instrument specifies the classes of temporary visas that a person must hold, or have applied for, to be eligible for English courses. Holders of these specified temporary visas are eligible for the AMEP, if they meet all other eligibility criteria as specified in the IE Act.

407 Training - Sponsorship Requirements

The Amendment Regulations provide that in order for an applicant to make a valid application for a Subclass 407 visa, the applicant must have an approved temporary activities sponsor and if the sponsor is not a Commonwealth agency, the applicant must also have a current, approved nomination for a program of occupational training. Prior to these amendments, an application for a temporary activities sponsor, nomination and Subclass 407 visa could be made concurrently, with temporary activities sponsor and nomination approval required prior to the grant of a Subclass 407 visa.

Arrival Control Determination - Iran 600 visa

This legislative instrument is an arrival control determination that specifies, for the purposes of subsection 84B(1) of the Migration Act, a class of non-citizens to whom section 84E of the Act applies. The specified class of non-citizens is a non-citizen:

  1.     who, at any time during the period for which the Determination is in force, holds a Subclass 600 (Visitor) visa; and
  2.     who gave (or caused to be given) to the Minister or to the Department, in relation to the application for that visa, the passport number of a passport that was
    - issued to the non-citizen by the Islamic Republic of Iran; or
    - issued to another person by the Islamic Republic of Iran and the non-citizen was included in the passport; and
  3.      for whose visa the Department has made a record that associates that passport number with the grant of that visa.

Australian Citizenship - special residence requirement

for the purposes of the special residence requirements under section 22B of the Citizenship Act.

AMSR methodology update

The purpose of LIN 26/038 is to amend the Migration (IMMI 18/033: Specification of Income Threshold and Annual Earnings and Methodology of Annual Market Salary Rate) Instrument 2018 (IMMI 18/033) to provide persons who make a nomination in relation to certain visa subclasses with an alternative method for determining the Australian Market Salary Rate (AMSR) that applies to the nominated position. The relevant visas are:

  • Subclass 482 (Skills in Demand) visa (SID);
  • Subclass 494 (Skilled Employer Sponsored Regional (Provisional)) visa (SESR);
  • Subclass 186 (Employer Nominated Scheme) visa (ENS);
  • Subclass 187 (Regional Sponsored Migration Scheme) visa (RSMS).

    Applicants are not required to satisfy the New Zealand stream specific criteria relating to a period of residence in Australia, minimum taxable income and health. In addition, family members of primary applicants who made a Subclass 189 (Skilled – Independent) visa application in the New Zealand stream prior to the commencement of the Amendment Regulations are also not required to satisfy the health criteria. Migration Agents Code of Conduct

The Code of Conduct for registered migration agents is set out in legislation to regulate the conduct of registered migration agents. 

The Code of Conduct:

(a) protects clients of migration agents; and

(b) strengthens the integrity of the immigration advice industry and Australia’s immigration system.


Provision for a Code of Conduct for migration agents is set out in Section 314 of the Migration Act 1958.
