Resident Return Visa - Subclass 155/157

If you are a permanent resident and you leave Australia after your permanent visa travel facility has expired, you will not be able to return to Australia as a permanent resident. If you wish to return to Australia as a permanent resident, you must apply for and be granted a new permanent resident visa. A resident return visa could be one of your options. Alternatively, you may wish to consider your eligibility for Australian Citizenship so you can travel on an Australian passport.

 

Basic eligibility requirments:

- the most recent permanent visa is not / was not subject to cancellation action on business grounds for a business skills visa

- the applicant is an Australian permanent resident or a former Australian permanent resident whose most recent permanent visa was not cancelled or 

- the applicant was an Australian citizen but has subsequently lost or renounced Australian citizenship

 

155 Five Year Resident Return Visa (can be granted with up to 5 years travel facility)

- the applicant:

1. meets residency requirements OR

2. the applicant is outside Australia and has substantial business, cultural, employment or personal ties with Australia which are of benefit to Australia and

(a) has not been absent from Australia for a continuous period of 5 years or more immediately before the application for the visa, unless there are compelling reasons for the absence, and the applicant:

(i) holds a permanent visa; or

(ii) last departed Australia as an Australian permanent resident; or

(iii) last departed Australia as an Australian citizen, but has subsequently lost or renounced Australian citizenship; or

(b) was an Australian citizen, or an Australian permanent resident, less than 10 years before the application, and has not been absent from Australia for a period of, or periods that total, more than 5 years in the period from the date that the applicant last departed Australia as an Australian citizen or Australian permanent resident to the date of the application, unless there are compelling reasons for the absence. OR

3. the applicant is in Australia and has substantial business, cultural, employment or personal ties with Australia which are of benefit to Australia and has not been absent from Australia for a continuous period of 5 years or more since:

                              (i)  the date of grant of the applicant's most recent permanent visa, unless there are compelling reasons for the absence; or

                             (ii)  the date on which the applicant ceased to be a citizen, unless there are compelling reasons for the absence. OR

4. the applicant is a member of the family unit of a person who has been granted a 155 visa

 

 

157 Three Month Resident Return Visa (granted with 3 months travel facility)

- the applicant

1. was lawfully present as a permanent resident or Australian citizen in Australia for a period of, or periods that total, not less than 1 day but less than 2 years in the period of 5 years immediately before the application for the visa and 

(i) has compelling and compassionate reasons for departing Australia; or

(ii) if outside Australia, had compelling and compassionate reasons for his or her last departure from Australia OR

2. the applicant is a member of the family unit of a person who has been granted a 157 visa

-  If the applicant is outside Australia, the applicant has not been absent from Australia for a continuous period of more than 3 months immediately before making the application for the visa, unless there are compelling and compassionate reasons for the absence.

  • THIRD WHV FROM 1 JULY 2019

    26.2.2019

    Amending Regulations have been published to introduce the previously announced third WHV 417 and 462 visa.

    A person is required to complete 6 months specified work in order to be eligible for a third 417/462 visa.

    The specified work must be undertaken:
    - after 1 July 2019 AND
    - while holding a second 417/462 or while the applicant held a bridging visa that was in effect and was granted on the basis of the application for the second 417/462 visa.





  • 1 November 2018 WHV AGE LIMIT INCREASED FOR CANADA AND IRELAND

    Canadian and Irish applicants for the Subclass 417 (Working Holiday) visa have an upper age limit increased from 30 to 35. More info here




  • 31 OCTOBER 2018 NEW PATHWAY TO PR FOR 405/410 HOLDERS

    From 17 November 2018, holders or former holders of 405 and 410 temporary retirement visas (retirees) are able to obtain permanent residence by meeting criteria in specified permanent visas.

Migration Agents Code of Conduct

The Code of Conduct for registered migration agents is set out in legislation to regulate the conduct of registered migration agents. 

The Code of Conduct:

(a) protects clients of migration agents; and

(b) strengthens the integrity of the immigration advice industry and Australia’s immigration system.


Provision for a Code of Conduct for migration agents is set out in Section 314 of the Migration Act 1958.
